These are the terms and conditions for a lifetime membership. By purchasing this membership, you are also purchasing a commercial license to use my creations for profit. You must agree to the terms and conditions below. There is a one-time fee of $75(US), payable to Marianne Hartsfield, for this membership. This membership is valid for the life of this site.

While you are responsible for ALL of the terms and conditions listed here, I've put this in a Q&A format, for easy referencing. Click on a question/topic below and you'll be taken to the appropriate answer.

Is everything offered by you, copyrighted to you?
May I use your graphics to make tags, wallpaper, blinkies or anything else?
May I create derivative works from your graphics, including pixel images/graphics?

Q.	Is everything offered by you, copyrighted to you?
A.	Unless I state otherwise, Everything is copyrighted to me, Marianne Hartsfield, owner of MDHDesigns…. There may be times when I will share a creation that includes a graphic/image that I did not draw or an image that has been modified and derived from an image I have purchased a license to use. Do NOT claim my work as your own! It's rude, disrespectful, and just plain wrong. I alone hold the copyrights to what I share here.

Q.	May I use your graphics to make tags, wallpaper, blinkies or anything else?
A.	Yes! This membership entitles you to use anything offered for download on this site for both personal and commercial use. If you are interested in Derivative works , then check out the next question and answer below.

May I create "derivative works" from your graphics, including pixel images/graphics?

Yes! Derivative works are allowed under the condition that your finished product is more than 40% different than my original. This even includes transforming my creation to a pixel image with the exception of the pixel images I already offer. However, keep in mind that...

This only applies to those creations that are completely mine. Anything that is not completely, 100% mine is clearly marked underneath the preview picture with the © symbol and the original creator's name beside it (i.e. © Jane Braz)

One more thing...a "catch"...I would really appreciate the rights to use any pixel images in any way I want (but not required). I think that's fair.

I am totally supportive of those who can be inspired by my creations to create something entirely new.

Q.	May I share your creations with other groups/friends?
A.	Yes! Under the condition that you not share any file in its/their original state meaning that you must have made a sig tag, stationery, blinky, or some other form of work and must be shared in JPG, PNG or GIF format ONLY. No other format is allowed - this includes PSP, PSD and/or 'TUBES' or any format that allows the use of "layers".

Q.	If I make a sig tag, card, or whatever, how should I credit you?
A.	Credit directly on what you create using something from me is not expected or necessary, but is always appreciated. If you would like to add credit to me, you can view a sample of what it should look like by clicking here. You know where you got the original image from and if someone asks, then I'm sure you will have the decency and common courtesy to let them know. However, there are creations that will have my copyright already embedded into the image. In these instances, I request that you not remove the watermark.

Q.	I require a membership to my site, but the membership is free, can I still use your creations?
A.	Yes! Under the condition that you not share any file in its/their original state meaning that you must have made a sig tag, stationery, blinky, or some other form of work and must be shared in JPG, PNG or GIF format ONLY. No other format is allowed - this includes PSP, PSD and/or 'TUBES'! You may NOT use any of my creations to make anything that could be considered an element or component of any program. This includes masks, brushes, nozzles, and/or the like.

Q.	What are your terms of use for your tutorial results?
A.	What you make as a result of any tutorial written by me, is yours to do with as you please - period. Yes!! This includes commercial use. No credit to me is expected or necessary, however always appreciated.

Q.	May I use one of your creations in a tutorial that I write?
A.	No. Permission has been granted in the past and for those two or three people that have received permission from me, you still have it. Permission for this use will no longer be given.

Q.	May I share your tutorials with my own group/friend?
A.	No. You may not copy, give, sell or otherwise redistribute any of the tutorials in any form or fashion. However you are more than welcome to link to my tutorial index at: http://mdhdesigns.net/Tutorials/TutorialIndex.htm.

May I use your creations for commercial purposes?

Yes! Under this lifetime membership, you are entitled to make a profit from anything offered for download on this site under the terms and conditions of this agreement. You also acknowledge, understand and agree that I, Marianne Hartsfield, retain all copyrights to my original images. Also, see "derivative works".

Nothing offered on this site may be sold or mass produced for the purpose of selling or any monetary gain. If you wish to use any of the images within this site for mass production (producing products on a scale of over 50 - i.e. stationery, labels, patterns, etc.). Any mass production of the offerings on this site, requires a special, non-exclusive license agreement and the price of this license agreement will depend upon the intended use. For example... If you plan to use one of my creations on a t-shirt, and are planning on making and/or selling more than 50, then you must purchase a special license for it.

If you make a something (i.e. sig tag, stationery) using my creations only, then you may sell it. I cannot speak for someone else's work. I can only speak for my own. Let me say that again... I have no right to give you permission to sell or give anything you make using someone else's work. In other words, if you take one of my accents and use it on a tag in which you've also used an image of another artist, you cannot sell it, unless you have ALSO received permission from that artist to do so. This is totally ILLEGAL! You must have permission from all artists - not just me.

Q.	What are your terms for using the web sets offered here?
A.	These sets are available for personal and/or commercial use. You may use any set for both personal and/or commercial use. You may also purchase separately, the exclusive commercial license to a set. If you are interested in the exclusive use of a set, please e-mail me for further details. The price of each set will vary and you must agree to the terms and conditions set forth in the licensing agreement that will come with the set. Refunds will not be given for any reason. Furthermore, if you purchase the rights to use a set exclusively, I will remove the set from the entire site immediately upon payment and the set will never be offered on the site again. Do not alter my sets in anyway. If you need a different button or a bullet made, just e-mail me, I will make up to ten buttons for you. Mixing my set images with someone else's is just rude, so please don't do it. I don't expect you to use all of the graphics within each set, but please, please, please, don't mix and match with other sets. Do not claim my graphics or layout designs as your own work or try to re-sell it. The use of any graphics provided by MDHDesigns... on any site (or linking to any other site), featuring any kind of discrimination is ABSOLUTELY FORBIDDEN!!! This includes discrimination towards race, color, creed, religion, sex, national origin, sexual preference or orientation, age, or disability. No link or credit is required for any set.

Q.	Do you offer a warranty or what if your files freeze or make my computer shut down?
A.	MDHDesigns... makes no warranties, express or implied. Furthermore, I will not be held liable for any direct, indirect, consequential, or incidental damages (including damages from loss of business profits, business interruption, loss of business information, and the like) arising out of the use of or inability to use any files offered for download by MDHDesigns... If you come across a file or image you cannot open or use, let me know and I will do my best to save the file in the format you will be able to use.

Q.	May I make a suggestion?
A.	Yes!! I encourage any and all suggestions. Now I'm not saying that anything will come of it, but suggestions keep me on my toes and I like that. Just keep in mind that I can't draw something like a unicorn or a something really elaborate. Please keep it simple.
