These are the terms and conditions for anything and everything offered at MDHDesigns... for subscribers under the old 3-month membership, as well as anything previously offered on the site, before it became a membership site.  Please, when referring to my terms and conditions, provide a link to this page instead of copying or plagiarizing my words.  If you have any questions, concerns, suggestions, or just a comment, please do not hesitate to contact me. 

While you are responsible for ALL of the terms and conditions listed here, I've put this in a Q&A format, for easy referencing.  Click on a question/topic below and you'll be taken to the appropriate answer.

Q. Is everything offered by you, copyrighted to you?

A. Unless I state otherwise, Everything is copyrighted to me, Marianne Hartsfield, owner of MDHDesigns…. There may be times when I will share a creation that includes a graphic/image that I did not draw or an image that has been modified and derived from an image I have purchased a license to use.  Do NOT claim my work as your own! It's rude, disrespectful, and just plain wrong. I alone hold the copyrights to what I share here.

 

Q. May I use your graphics to make tags, wallpaper, blinkies or anything else?

A. Well, almost anything...  Yes!  I get a real kick out of seeing someone use the graphics I make and share.  Just don't charge anyone for anything you get from me.   Please provide a text link to MDHDesigns... (http://mdhdesigns.net) if any of my creations are used in making stationery or web set (linkware).  You may NOT use any of my creations to make anything that could be considered an element or component of any program.  This includes masks, brushes, nozzles, and/or the like.

As for the blank tags or tag templates you see on this site, you may add anything you like to the template, but you may NOT take anything away from the template.  This includes my embedded watermarks!!  They are to be used 'as is' - no exceptions.

 

Q. May I create "derivative works" from your graphics, including pixel images/graphics?

A. No.  But check out what you can do with a Lifetime Membership!

 

Q. May I share your creations with other groups/friends?

A. Yes!  Under the condition that you not make a profit of any kind (like selling them or trading them for something else) or share any file in its/their original state meaning that you must have made a sig tag, stationery, blinky, or some other form of work and must be shared in JPG, PNG or GIF format ONLY.  No other format is allowed - this includes PSP, PSD and/or 'TUBES' or any format that allows the use of "layers".

 

Q. If I make a sig tag, card, or whatever, how should I credit you?

A. Credit directly on what you create using something from me is not expected or necessary, but is always appreciated.  If you would like to add credit to me, you can view a sample of what it should look like by clicking here.  You know where you got the original image from and if someone asks, then I'm sure you will have the decency and common courtesy to let them know.  However, there are creations that will have my copyright already embedded into the image.  In these instances, I request that you not remove the watermark.

 

Q. I require a membership to my site, but the membership is free, can I still use your creations?

A. If you require your members to pay you any kind of fee for anything you have or will create, then you are considered to be a commercial site and will need to purchase a commercial license.  Please refer to the Lifetime Membership option.

 

Q. What are your terms of use for your tutorial results?

A. What you make as a result of any tutorial written by me, is yours to do with as you please - period.  Yes!!  This includes commercial use.  No credit to me is expected or necessary, however always appreciated.

 

Q. May I use one of your creations in a tutorial that I write?

A. No.  Permission has been granted in the past and for those two or three people that have received permission from me, you still have it.  Permission for this use will no longer be given.

 

Q. May I share your tutorials with my own group/friend?

A. No.  You may not copy, give, sell or otherwise redistribute any of the tutorials in any form or fashion.  However you are more than welcome to link to my tutorial index at:

Q. May I use your creations for commercial purposes?

A. No.  My creations are to be used for personal use only.   NO profit is to be made from them whatsoever unless you purchase a commercial license from me.  If you require your members to pay you any kind of fee for anything you have or will create, then you are considered to be a commercial site and will need to purchase a commercial license.  If you'd like to use something commercially, please check out the Lifetime Membership option.

 

Q. What are your terms for using the web sets offered here?

A. These sets are only available for personal/non-commercial use ONLY!
  1. You may use any set for non-commercial/personal use only.  You may also purchase separately, the exclusive commercial license to a set.  If you are interested in the exclusive use of a set, please e-mail me for further details.  The price of each set will vary and you must agree to the terms and conditions set forth in the licensing agreement that will come with the set.  Refunds will not be given for any reason.  Furthermore, if you purchase the rights to use a set exclusively, I will remove the set from the entire site immediately upon payment and the set will never be offered on the site again.

  2. Do not alter my sets in anyway. If you need a different button or a bullet made, just  e-mail me and I will do it for ya.. its no problem, really!  I will make up to ten buttons for you.

  3. Mixing my set images with someone else's is just rude, so please don't do it.  It defeats the whole purpose of making a "set".  I don't expect you to use all of the graphics within each set, but please, please, please, don't mix and match with other sets.

  4. Don't claim my graphics or layout designs as your own work or try to re-sell it.  You may use the layout I have provided in the HTML document as a guide when building your site and nothing more. 

  5. The use of any graphics provided by MDHDesigns... on any site (or linking to any other site), featuring any kind of discrimination is ABSOLUTELY FORBIDDEN!!!  This includes discrimination towards race, color, creed, religion, sex, national origin, sexual preference or orientation, age, or disability.

  6. A link back to MDHDesigns... MUST be placed prominently on each page you use my set images.   In fact, Just do us both a favor and leave the my button link logo at the bottom.  It's not that big, it doesn't ruin anything as far as the look goes, it won't distract from your content, and it's not so much to ask.  Please link to:  http://mdhdesigns.net. 

Q. Do you offer a warranty or what if your files freeze or make my computer shut down?

A. MDHDesigns... makes no warranties, express or implied.  Furthermore, I will not be held liable for any direct, indirect, consequential, or incidental damages (including damages from loss of business profits, business interruption, loss of business information, and the like) arising out of the use of or inability to use any files offered for download by MDHDesigns...

If you come across a file or image you cannot open or use, let me know and I will do my best to save the file in the format you will be able to use.

 

Q. May I make a suggestion?

A. Yes!!  I encourage any and all suggestions.  Now I'm not saying that anything will come of it, but suggestions keep me on my toes and I like that.  Just keep in mind that I can't draw something like a unicorn or a something really elaborate.  Please keep it simple.
